The following terms and conditions represent a legal binding agreement between the clients Ads Lagao Media Solutions (the parent company) regarding utilization of the website www.adslagao.com.  On accessing the site or service and/or by clicking “I agree”, you agree to be bound by the terms displayed by us. You hereby represent and authorize to the Company that you are at least eighteen (18) years of age or above and are capable of entering, performing and adhering to these rules and you agree to be bound by the following terms and conditions. While individuals under the age of 18 are permitted to access the site, they shall do so only with the involvement & guidance of their parents and/or legal guardians. Further, their activities should occur under their Parent /Legal guardian’s registered account. Consumers are urged to register themselves prior to uploading any content or utilization of the site’s services. Clients should provide proper details such as complete name, age, email address, residential address and contact number amongst others.

“User” or “You” describes any person who accesses or avails the Company’s site for the purpose of hosting, publishing, sharing, transacting, displaying or uploading information or views and includes other people jointly participating in the utilization of the site.

Disclaimer

ADS LAGAO should be not held liable for any inaccurate/misleading information/advertisement. The prices regarding various offers mentioned on the website keep on changing as per the guidelines of different newspapers. ADS LAGAO’s team remains in constant touch with publication houses to update the prices as they are circulated by them. However, some differences might occur and in such a scenario ADS LAGAO would not entertain any requests. This responsibility should be undertaken by the end-user to research/verify / accept bona fide content. ADS LAGAO should not be considered responsible for actions taken by publishers/clientele based on the information provided on our website.

Content of Advertisement

Complete information of whatsoever nature received from the user/advertiser is taken in good faith, without suspecting the authenticity of the advertiser. The contents of the advertisement are believed to be true and in compliance with the laws of India. The Advertiser is bound to indemnify the Newspaper/ portal / website of any action legal/civil that may follow as a consequence of the specific advertisement.

Ad Preview

The Advertisement preview shown to a user is an indicative preview of the ad text only and various times it may differ from the actual published advertisement. Such change is beyond the control of ADS LAGAO and the organization dissolves its responsibility in this regard. Furthermore, the organization wants to inform that no dispute in this regard will be entertained.

Schemes, Discounts, Services

ADS LAGAO reserves the sole discretion and irrevocable right to-offer/not offer schemes/services/products/new features/discounts/promotional packages on its website exclusive to any existing or future media, known or unknown mode and vice versa.

Compensation

The advertiser should not expect compensation from ADS LAGAO for any action or claim by any third party resulting from any advertisement instructed by the advertiser or its agency.

Limitation of Liability

ADS LAGAO cannot be held liable for any loss to the advertiser regarding any error or omission. Cancellations and alterations will be accepted only in writing and before the request has been processed.

Cancellation

ADS LAGAO shall reserve the exclusive right to cancel any content whatsoever from being published or reflected on its website or in any other mode. The refunded amount would be returned within a period of 10-15 business days with 25% deduction.

Cancellation Policy and Procedures

This will be purely an offline cancellation process and depends on whether the ad request is already processed/ forwarded to the corresponding newspaper for publishing or not.

For assured cancellation, user needs to send a written communication to the customer care team along with requesting cancellation of the advertisement. The request should be made within 48 hours from date of booking. Cancellation Charges (25%).

Justified and accepted complaints entitle advertisers to a maximum refund of the amount equivalent to the value of disputed and unpublished ads.

Request Raised within 48 hour

  • Ad is cancelled (Cancellation Charges Apply)
  • Ad is cancelled if not scheduled (Charges Apply)

Ad Cancelled after 48 hours

  • Incase Ad is scheduled by publisher no cancellation will be done. However, an effort is made to stop it from being published ( Depends on publisher)

Add Missed by a Newspaper

  • Full amount refunded on request
  • Rescheduling is allowed

Request for rescheduling/ Change of Ad text/adding more publication

  • Allowed if not scheduled already
  • No Charges apply
  • Fresh dates will depend upon available
  • For extra amount online invoice will be sent. User will have to pay the extra amount if at all required

Documents not received on time

  • Ad will not be published
  • For cancellation request cancellation charges will apply

Text not accepted by any newspaper

  • Fresh Schedule can be done
  • For cancellation charges apply

Duplicate Ad/Payment

  • Cancellation charges will NOT apply

Modifications to Terms and Conditions

ADS LAGAO in its sole discretion shall reserve the right to modify the Terms & Conditions any time and without prior notice to its users/advertisers, and edit, modify and alter the content of the advertisement.

Rescheduling Advertisement

ADS LAGAO reserves the right to decline, change or reschedule any advertisement/listing notwithstanding earlier acceptance.

Refusal of Service

If ADS LAGAO, in its sole discretion, determines that a violation of the Terms & Conditions has occurred, we are entitled to pursue legal remedies, including but not limited to the cancellation of the user’s account and/or the exclusion of any person(s) who may have violated any of the Terms & Conditions. In sum, ADS LAGAO reserves the right to refuse service to anyone at any time, and to remove any listings or any advertisements for any reason, without prior notice.

Applicable Taxes and Costs

User understands and agrees that he/she is responsible for all applicable taxes and costs which are incurred as a result of ADS LAGAO’s service. We may also, in our sole discretion, add or delete fees associated with the service.

Disclaimer of Warranties

User agrees that benefits of the service will be enjoyed at his/her sole risk. The service is provided on an “as is” and on an “as available” basis. ADS LAGAO expressly refuses to acknowledge warranties of any kind; whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

No Warranty of Service

ADS LAGAO makes no warranty that the service will completely fulfill user’s requirements, that the service will be uninterrupted, timely, secure, or error free; nor does ADS LAGAO make any warranty as to the results that may be obtained from the use of the service or as to the accuracy or reliability of any information obtained from the service.

Governing Law

These Terms & Conditions and the relationship between User and ADS LAGAO shall be governed by the laws of West Bengal, without regard to its conflict of law provisions. User and ADS LAGAO agree to submit to the personal and exclusive jurisdiction of the courts located within the State of West Bengal

Filing of Claim

User agrees that regardless of any statute or law to the contrary, any claim regarding ADS LAGAO’s services need to be made within 10 days.

Acceptance of Advertisements

ADS LAGAO is accepting advertisements only on behalf of the publications featured on the site. It is in no way responsible for any delay by the publications to discharge any of their obligations towards the users.

Reporting Violations of Terms and Conditions

Acknowledgment and Acceptance of Terms and Conditions

The terms and conditions appearing here consist of the entire agreement between the Party/User (as defined above) and the Company (as defined above).

Personal Services

Advertisements are accepted in good faith but ADS LAGAO does not accept responsibility for their veracity, delay, error, omission in publication, shrinkage in production, compliance with all relevant laws, etc. The advertiser and/or publisher will compensate ADS LAGAO for any action or claim brought by any third party arising directly or indirectly from publication or non-publication of an advertisement including but not limited to infringement of any law/statutory requirement etc.

Payment Terms

  • All payments are required to be confirmed with us, 3 days before final publication.
  • Overdue accounts will be subject to a service charge of 2% per month.
  • All disputes need to be resolved under the jurisdiction of West Bengal court.
